Executive Summary

The civil courts have been unwilling to review pastoral terminations for any reason. This often is called the "ecclesiastical abstention doctrine." The reason is that the first amendment guaranty of religious freedom prevents the civil courts from deciding "who will preach from the pulpit" of a church. The decision to this question, however arbitrary or discriminatory, must come from the church. This lesson will review this important rule and its possible exceptions.
