Dismissing Employees for Filing a Workers Compensation Claim

Key Point 8-07.03. In many states employers can be sued for dismissing or in any way discriminating against an employee who files a workers compensation claim.

Several states have enacted legislation prohibiting employers from terminating employees for filing a workers compensation claim. The same result is obtained in some states by judicial decision.
