The minimum wage and overtime requirements of the FLSA apply to enterprises engaged in commerce, or individual employees who are engaged in commerce in the performance of their duties. How do you know if this requirement applies to your church? Ask:
- Do we order teaching materials or other supplies from out of state?
- Do we send newsletters or other information to people out of state?
- Does anyone on staff travel out of state as part of their job?
- Does our ministry have a website where people out of state order items?
If you answered yes to any of these, you probably engage in interstate commerce and need to comply with the FLSA.
