• The Utah legislature has enacted a law requiring private schools to conduct criminal records checks of prospective employees and volunteers. Criminal records checks of current workers is allowed if “reasonable cause” exists. Fingerprints are required if necessary to confirm a person’s identity. The state bureau of criminal investigation is required to release all records of criminal convictions, but school personnel can only consider “job-related” convictions in making employment decisions. Persons who are denied employment or dismissed because of such information must receive written notice of the reasons and be given an opportunity to respond.
